Default Insurance question!

So recently my car was involved in an accident. A car rear ended my car causing my car to rear end another. The thing is, the person that caused the accident does not have insurance, current registration, and doesn't even have a drivers license. A 60 year old haspanic women yapping away with her passenger and not paying attention. Also, not having insurance, current registration and license is illegal in the state of California. I have full coverage along with uninsured motorist protection. Now my question is, would it even be wise to file a bodily injury claim with my insurance company if the other side doesn't even have insurance? My brother was the victim and from what he says, he is sore. He went to the emergency room when it happened but all they said was.."since you where sitting where the vehicle didn't get impact, you aare ok". He is going back to the doctors today just to make sure. Any help is much appriciated.

Get a lawyer man. I recommend this because they might be seeing something you don't see or a much better option. Well worth the money +learning experience IMO.

not sure how you end up ahead in this one. You could sue, but then she goes to jail and you don't get paid. You could report it to your insurance, but you still have to pay your deductible and your rates could still go up. Obviously its the hispanic lady's fault but I'm guessing if you get an estimate for your car and the other one, that she will be unable to pay.

I'd get an estimate and if its something reasonable that she can pay, go that route, if its a few thousand, then I'd call insurance...

I had some old drunck hispanic dude ram into my driver side fender when I was in a restaurant .so I jumped out and started wallin juss so he can get scared I was like im callin da copss he was like no no no he was like wa can we do here. I was like give $140 cash and he did. I copped 2 new fenders and jdm amber corners lol f***it .ma point is c how much u can get from da lady keeping in mind if ya damage is a lot of money that u no she can't pay den get a lawyer

My insurance company is taking care of it. I don't find it neccessary to get a lawyer cause the b**** doesn't have any money anyways. Which is why she is driving with expired registratin and NO insurance. The question was,is it even worth filing bodily injury against MY OWN insurance. s***, you proved you don't know s*** like you stated so if you can't answer the question, don't answer at all.

file the claim your Uninsured motorist coverage (if you have it) will pay out the damages (up to your coverage limit) and not affect your rates. so long as the police report has the person that hit you and her information so they can go after her.

You are at fault for the collision in the instance you rear ended the person in front of you, and your rates could (and most likely will) go up from that.

Yes, I do have UM Coverage. My insurance company already made contact with the party who rear ended my car. Confirmed she doesn't have insurance or a license. On the other hand, when she rear ended my car..she kept her foot on the gas instead of hitting the brake which pushed my car into the car infront and after my car made contact with the car infront, we were still moving and pushed both our cars into the 4th car. My brother even had enough time to react and apply more brake and pull the e-brake. Now keep in mind, this was at a traffic light where traffic has been stopped and not moving.

i was just giving worse case... in the instance you speak of where you were pushed into the car in front of you. Insurance companies side with the person that was rear ended.. stating that proper following distance wasn't utilized.
but in this case.. there might be a different resolution. good luck

I've been in the same situation as you twice! Even if the person that hit you doesn't have any money your insurance company will sue their asses anyway. You get the money you need regardless and your insurance company will deal with the other party themselves. I don't want to get into my stories because they are long and I'm not high enough to ramble on.
