I was pulled over doing 57 in a 45 on my way home from work a couple weeks ago. I wasn't even in a hurry that's just naturally how fast my foot wants me to go. Anyways, the cop dropped it to 54 in a 45. He got me while he was heading the other direction so I'm guessing he used radar because he couldn't pace me and he couldn't estimate my speed well either. So how would I approach this in court? I am not about to get an insurance jump I'm already a 19 year old male with 3 points it's expensive enough.
Just a thought my speedometer might be off. I had the little 13" hubcaps and then I switched to SI wheels with 215s (big tires, I know). Would I just need a receipt from a mechanic or tire dealership saying thats not the original tire size for a DX hatchback?

I got out of a speeding ticket once,
A friend told me that every radar gun has to be inspected/tested every two weeks or so in WA, I went to the court house to look up the gun he used and then notice that he didn't give the serial number off the radar gun so there's no way to check. Judge dismissed it. I don't know how the laws in NC differ.

Get an attorney.
You can get the cop to change his story and contradict himself and the judge still won't give a damn. You'll be found guilty. It sucks but that's the way it works sometimes.

Dude,
If you try and bring up the serial # excuse, you'll be laughed out of court, Lawyer and all. If you make the excuse of switching wheel sizes, #1. you shoulda knew that would happen and #2 they'll tell you the same thing regardless if you have a recepit or not. As soon as they look at your age and # of points, you're done. Just pay the ticket and slow down because you obviously pick the wrong spots.

If you try and bring up the serial # excuse, you'll be laughed out of court, Lawyer and all. .
If you hire the right attorney, you'll probably never see the courtroom. He'll just keep the case postponed until such time that the municipal court no longer wants to pursue the case.

dood just got a mechanic what not and have them write something that says you had improper equipment but now you got it fixed and im sure they will drop it.....happend to me *true story*

Just pay the ticket. You were speeding. If you speed you get a ticket. That's like a car theif trying to sue you because he got cut while trying to still your car. You were wrong. I use to get stupid speeding tickets too I just got a pig detector. Haven't got one since I got it.

The real funny thing is that when I do get a ticket, I have to hide it from my wife and let her find out by herself when she gets the insurance bill :oops: I have to think of a good excuse and it's never my fault, the cops are just fucking with me :lol: Oh man does she let me have it and I get tickets regularly too :( $$$$$$

And you know this how? Are you a Judge? I wasn't the only one in court doing this, other people had their lawyer say it for em.
Any time a cop makes a mistake on the ticket it's grounds for dismisal.
I've had friends get off for dates being wrong. MPH over limit being wrong, etc.

And if you decide to fight it and lose they aren't going to tack on more tickets (where did you hear that, bizoneoeh?), and the fine won't go up... the only reason to pussy out and pay the ticket is if you've either got money flowing out your ass or you're too busy to spend an extra 1 hour in court on a different date. I know that the longer you can delay a court date the more likely the cop won't show up. And for all the state knows, I bought the car with those wheels on and had no way of knowing that my speedometer was off. I've done the 'just pay the ticket' thing and it's stupid. Especially when you have nothing to lose by challenging it. I didn't ask you guys if I should pay it or not, I asked how to get out of it... thank you to all who offered that. How about this....lesson learned. take it in the shorts and spend a little money on something called a RADAR DETECTOR. Don't by no shitty cobra or walmart one. Get an escort password 7500 or higher or a Bel RX65 or higher if they have them out yet. RADARTEST.COM is a great site for reviews.
Its an investment and they work pretty good. Saves me a lot. I imaging if you had that, you would have gotten plenty of notice to slow down. They save me all the time. I drive about 2k miles a month and about once a week it saves me, even if i'm going with the flow of traffic i'll slow down and change lanes to be on the safe side.
My radar detector has paid for itself a number of times. Places that are 45 that everyone goes 65 on at night, well saved me there by a full mile cause i woulda been doing 65.
Just take it in the shorts, pay it, lesson learned like i said, and make an investment.

I didn't hear that, it happened to me. Well kind of happened to me. I got stopped and I used that excuse of faulty equipment and got cited another ticket for driving like that. If they want to be dicks they can of course. If you try to fight something you're guilty of it just might make then be real assholes. that's why I just say pay the ticket. :D

I told them my speedo cable was out so I didn't know how fast I was going. I also told them that it just had happened. Beleive me, they've heard it all.

I know in MD well baltimore county anyway taht if you get a ticket for speeding and goto court and plead guilty 99% of the time you get PBJ unless you were going like 20+ over or your the retard that trys to plea not guilty and makes up excuses them they rape you

That's another option.
Dress nice, go to court, plead no contest and respectfully ask the judge for deferred adjudication.
If the judge agrees then your guilty verdict will be postponed until you complete a probationary period. At that time your guilty verdict will go away. If you get another citation during your probationary period then the guilty verdict sticks and you get the points tacked on.
Sometimes the judge will allow a reduced fine for deferred adjudication too.

I don't know how the wrong serial number on a radar equals a mistake on the speeding ticket......? I'm no Judge, but I'l tell you something, if you were, I'd love to have you as my Judge if that's your logic.
