Rhythmically fluctuating idle, undriveable upon cold start

Yesterday I had to have my 2012 Civic LX sedan towed to the dealer for the third occurrence of the same problem. Here are the symptoms: upon starting the engine, the idle rhythmically fluctuates from 1500 to 2000 rpm. While the idle is fluctuating pressing the accelerator has no effect and therefore the car cannot be driven.

The warning system says check VSA, power steering, and emission.

Both times the dealer pulled fault code 1659. The first time the dealer didn't take any corrective action because by the time I got it there the warnings weren't showing anymore. Then I didn't have trouble for 3 weeks. The second occurrence the dealer replaced the Engine Control Module. The problem recurred just one day later (yesterday).

Any ideas? I fear I may be on a path toward having to consult a Lemon Law attorney.

The Honda dealer should fix the problem under the factory warranty. Let them deal with it.
